TERMS AND CONDITIONS OF SALE

Article 1 – Seller Identification
These Terms and Conditions of Sale (T&Cs) apply to all sales made through the website www.kometeatelier.com, operated by:
SNR Society OÜ, a private limited company governed by Estonian law, with a share capital of €1, registered with the Estonian Commercial Register under number 17333898, whose registered office is located at Sepapaja tn 6, 15551 Tallinn, Estonia.
Trade name: Komète Atelier.

Article 2 – Purpose
These T&Cs govern the sale of jewelry, accessories, and related products offered on www.kometeatelier.com.
Any order placed on the site constitutes full and unconditional acceptance of these terms by the customer.
Article 3 – Products
The products available for sale are those displayed on the website, subject to stock availability.
Certain items may be made to order or customized at the customer’s request (e.g., size adjustments, specific assembly, pre-orders).
Such items are not subject to the right of withdrawal (see Article 9).
Article 4 – Orders
Orders may be placed with or without creating a customer account.
No minimum purchase amount is required.
Sales are open to consumers (B2C) and business customers (B2B).
Article 5 – Prices and Taxation
Prices are displayed in euros, all taxes included (VAT).

European Union (EU): VAT collected through the OSS (One Stop Shop) scheme.

France: French VAT applies for items shipped from stock located in France.

United Kingdom:

Orders < £135: UK VAT is charged and remitted to HMRC by Komète Atelier.

Orders ≥ £135: import VAT and duties are paid directly by the customer to the carrier.

Outside the EU/UK: prices are displayed excluding taxes; import duties and taxes are payable by the customer.
Prices include applicable eco-contributions and environmental fees, where relevant.
Komète Atelier reserves the right to modify its prices at any time, but items will be invoiced at the rate in effect when the order is confirmed.
Article 6 – Payment Methods

No payments by check, cash, or other unlisted methods are accepted.
For custom-made items: a deposit is required at the time of order, with the balance due before shipping.

Article 7 – Delivery

France & Overseas territories: free shipping.

Rest of the world: free shipping for orders over €69.

Average delivery times: processing 1–2 business days, transit 1–3 business days.

Legal maximum delivery time: 30 days from the order date; beyond that, the customer may request cancellation and a full refund.
Deliveries are handled by French logistics partners (La Poste, Colissimo, Chronopost).
In case of a delay exceeding 10 business days, the customer may cancel the order by email or registered mail and receive a full refund within 14 days.
Article 8 – Retention of Ownership
Products remain the property of Komète Atelier until full payment of the order (including principal, fees, and taxes).
Article 9 – Withdrawal and Returns

In accordance with Directive 2011/83/EU and the French Consumer Code:
The customer has 14 days from receipt of the goods to exercise the right of withdrawal.
Excluded items: customized products, earrings (for hygiene reasons), and pre-orders.
Return procedure:

Approved form must be included inside the parcel
Return shipping costs: borne by the customer (except under warranty).
Refunds: product price + standard delivery costs (excluding express options), within 14 business days after inspection of returned goods.
📌 A model withdrawal form (Annex I – Directive 2011/83/EU) will be attached to these T&Cs.
Article 10 – Warranties
Legal Warranty:

Conformity: 2 years (Articles L217-3 et seq., French Consumer Code)

Hidden defects: Articles 1641 to 1649, French Civil Code
The consumer benefits from a two-year period from delivery to invoke the warranty, at no cost.
Komète Atelier Commercial Warranty:

Duration: 2 years

Covers: manufacturing defects, non-conformity, abnormal oxidation or corrosion

Return shipping: covered by Komète Atelier

Resolution: repair → replacement → refund (if previous options impossible)
Article 11 – Customer Service

Article 12 – Intellectual Property
The Komète Atelier brand is registered.
All website content (visuals, logo, design, packaging, social media) is protected.
Any reproduction or unauthorized use is strictly prohibited.
Article 13 – Personal Data
Komète Atelier collects customer data for order management, invoicing, delivery, marketing, and partnerships.
Legal basis: contract performance, legal obligation, consent (newsletter), legitimate interest (analytics).
Retention: for as long as necessary for the stated purposes (orders: during the relationship + statutory period; marketing: until consent is withdrawn).
Rights: access, rectification, erasure, portability, objection.
Tracking tools: Google Analytics, Meta Pixel, cookies (managed via the consent banner).
Account deletion available upon request.
Data controller: SNR Society OÜ.
Data is hosted within the European Union. No data is transferred outside the EU without adequate safeguards.
Article 14 – Gift Cards and Pre-Orders
Gift cards and store credits are valid for 12 months.
Pre-orders require immediate payment and are shipped on the announced release date.
Pre-ordered products are non-returnable (considered personalized items).
Article 15 – Disputes and Mediation
These T&Cs are governed by Estonian law, based on the registered office of SNR Society OÜ, without prejudice to consumer rights in their country of residence.
In the event of a dispute, customers may use the European ODR platform:

For the United Kingdom: governed by the Consumer Rights Act 2015.
In accordance with Article L612-1 of the French Consumer Code, the customer may refer any unresolved complaint to a consumer mediation service, free of charge.

Article 16 – General Clause
If any provision of these T&Cs is deemed invalid, the remaining provisions shall remain fully applicable.
